Terms of Service

These Terms of Service ("Terms") govern your access to and use of the HomeCommand website and application (collectively, the "Service"). Please read them carefully. By creating an account or using the Service you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the Service — including by creating an account, uploading a document, or browsing the HomeCommand website — you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

These Terms constitute a legally binding agreement between you and HomeCommand Inc.

2. Description of Service

HomeCommand is a document intelligence platform for homeowners. The Service allows you to:

  • Upload property documents (inspection reports, appraisals, home warranties, and seller disclosures) in PDF format.
  • Receive AI-powered extraction and structuring of the data in those documents, including identification of issues, home components, and equipment.
  • Manage an interactive home dashboard showing property condition, open issues, and maintenance schedules.
  • Upload and organise property photos.
  • Use an AI assistant (chatbot) to ask questions about your property documents.
  • Track warranties, maintenance tasks, and home equipment inventory.
  • Search for local vendors and service providers near your property.
  • Invite household members or real estate agents to view your property data.

We reserve the right to modify, suspend, or discontinue any feature of the Service at any time with reasonable notice.

3. Eligibility

You must be at least 18 years old to use the Service. By using the Service you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.

4. Account Registration

You must create an account to access most features of the Service. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Keep your login credentials confidential and not share them with any third party.
  • Notify us immediately at support@homecommand.ai if you suspect unauthorised access to your account.
  • Be responsible for all activity that occurs under your account.

You may sign in using an email address and password, or via Google OAuth. By using Google OAuth you also agree to Google's Terms of Service.

We reserve the right to suspend or terminate accounts that contain inaccurate information or that violate these Terms.

5. Your Content

"Your Content" means any documents, photos, text, or other materials you upload to or create within the Service.

You retain all ownership rights in Your Content. By uploading content to HomeCommand you grant us a limited, non-exclusive, worldwide, royalty-free licence to store, process, and display Your Content solely for the purpose of providing the Service to you.

You represent and warrant that:

  • You own or have the right to upload and use Your Content.
  • Your Content does not infringe any third-party intellectual property rights.
  • Your Content does not violate any applicable law.

We do not use Your Content (including your property documents) to train AI models without your explicit consent.

6. AI-Generated Outputs — Important Disclaimer

HomeCommand uses artificial intelligence to extract and structure information from the property documents you upload. This process is automated and may produce errors, omissions, or inaccuracies.

  • Not professional advice. Nothing in the Service constitutes licensed professional advice of any kind — including home inspection advice, legal advice, financial advice, engineering advice, or contractor recommendations. Always consult a qualified professional before making decisions about your property.
  • Not a substitute for inspection. The AI-extracted data reflects what is written in the documents you provide. HomeCommand does not inspect your property and cannot verify whether document information is current or accurate.
  • Completeness not guaranteed. The extraction process may miss issues, equipment, or conditions mentioned in your documents. Do not rely solely on the HomeCommand dashboard as a comprehensive representation of your property's condition.
  • Vendor suggestions. Any vendors or service providers shown in the Service are sourced from third-party location data providers. HomeCommand does not vet, endorse, or take responsibility for third-party vendors.

You assume full responsibility for any property decisions you make based on information displayed in HomeCommand.

7. Prohibited Uses

You agree not to:

  • Use the Service for any unlawful purpose or in violation of applicable law.
  • Upload documents or content that you do not own or have the right to share.
  • Upload malware, viruses, or malicious code of any kind.
  • Attempt to gain unauthorised access to any other user's account or data.
  • Scrape, crawl, or systematically extract data from the Service using automated means.
  • Reverse-engineer, decompile, or disassemble any part of the Service.
  • Use the Service to build a competing product or service.
  • Misrepresent your identity or impersonate any person or entity.
  • Interfere with or disrupt the integrity, performance, or availability of the Service.
  • Resell or sublicence access to the Service without our written permission.

We reserve the right to suspend or permanently ban any user who violates these prohibitions.

8. Subscription Plans and Billing

8.1 Plans

HomeCommand offers the following plans:

  • Basic (free): One property; limited features.
  • Pro: Multiple properties; full feature access. Priced at $15 USD per property per month (subject to change with notice).

8.2 Free trial

Pro includes a 14-day free trial. No payment is required during the trial period. At the end of the trial, your account will revert to the Basic plan unless you have added a valid payment method. You may extend your trial once by 14 additional days while a payment method is on file.

8.3 Payment

Paid subscriptions are processed by Stripe. By subscribing you authorise us to charge your payment method on a recurring monthly basis. All amounts are in US dollars and are exclusive of any applicable taxes.

8.4 Price changes

We may change our pricing at any time. We will give you at least 30 days' notice of any price increase before it takes effect.

8.5 Cancellation and refunds

You may cancel your Pro subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period; you will not be charged again. We do not offer pro-rated refunds for unused time in a billing period, except where required by law.

8.6 Failure to pay

If a payment fails, we will notify you and may suspend or downgrade your account until the outstanding amount is settled.

9. Intellectual Property

All intellectual property in the Service — including the software, design, trademarks, logos, and content we create — belongs to HomeCommand or its licensors. These Terms do not transfer any ownership rights to you.

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial use, subject to these Terms.

"HomeCommand" and the HomeCommand logo are trademarks of HomeCommand. You may not use our trademarks without our prior written consent.

10. Third-Party Services

The Service relies on third-party providers for cloud hosting, AI processing, location services, email delivery, and payment processing. Where you interact directly with a third-party provider — such as Google (for optional sign-in) or Stripe (for payment) — that provider's own terms and privacy policy also apply. HomeCommand is not responsible for the actions, content, or availability of third-party services.

Vendor search results are sourced from third-party location data providers. HomeCommand does not endorse, recommend, or verify any vendor listed in the Service, and is not a party to any agreement you make with a vendor.

11. Disclaimer of Warranties

Please read this section carefully.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF AI-GENERATED CONTENT.

We do not warrant that:

  • The Service will be uninterrupted, error-free, or free of security vulnerabilities.
  • Any AI-extracted data accurately represents the full content of your documents.
  • The Service is suitable for any specific purpose, including making property purchase or maintenance decisions.

12. Limitation of Liability

Please read this section carefully.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HOMECOMMAND AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE — INCLUDING DAMAGES FOR LOSS OF DATA, LOSS OF PROFITS, PROPERTY DAMAGE, OR LOSSES ARISING FROM RELIANCE ON AI-GENERATED CONTENT — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO HOMECOMMAND IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless HomeCommand and its officers, directors, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:

  • Your use of or inability to use the Service.
  • Your breach of these Terms.
  • Your Content, including any claim that Your Content infringes a third party's rights.
  • Any decisions you make based on information provided by the Service.

14. Termination

By you: You may close your account at any time by contacting us at support@homecommand.ai. Upon closing your account, your data will be scheduled for deletion per our Privacy Policy.

By us: We may suspend or terminate your access to the Service at any time, with or without cause, with reasonable notice where practicable. Grounds for termination include violation of these Terms, non-payment, or actions that harm other users or the Service.

Sections 6, 9, 11, 12, 13, 15, and 16 survive termination.

15. Dispute Resolution

In the event of any dispute arising from or relating to these Terms or the Service, the parties agree to first attempt resolution through good-faith negotiation for at least 30 days before pursuing any formal proceedings. If negotiation fails, disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association, except that either party may bring claims in small-claims court if they qualify.

If you are located in the European Economic Area or United Kingdom, you may also bring claims before the courts of your country of residence.

16. Governing Law

These Terms are governed by the laws of the United States and the state in which HomeCommand Inc. is incorporated, without regard to conflict of law principles. Any disputes not resolved by arbitration shall be brought in the courts of competent jurisdiction in that state.

If you are located in the European Economic Area or United Kingdom, you may also have the right to bring claims before the courts of your country of residence.

17. Changes to These Terms

We may update these Terms from time to time. When we make material changes we will update the "Last updated" date above and notify you by email or in-app notice at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.

If you do not agree to the updated Terms, you must stop using the Service and may close your account before the changes take effect.
